A nonprofit open source advocacy group in Quebec is taking the provincial government to court over its software procurement policies. The group, which is called FACIL, contends that the government has failed to comply with contract regulations by consistently adopting foreign proprietary software without first evaluating open source alternatives.
In a complaint filed with Quebec Superior Court, FACIL points out that the government awarded Microsoft CAN$10 million across seven different contracts, but never invited other vendors to propose bids. This behavior could fall afoul of regulations that require government agencies to solicit bids for contracts exceeding CAN$25,000. FACIL also cites a procurement guidelines document issued by the government of Quebec last year which instructs officials to define their operational needs during the procurement process in a way that is broadly inclusive and nonprejudicial towards open source solutions.
In ihrer Antwort auf eine Anfrage aus dem Europäischen Parlament hat die EU-Kommission erklärt, dass Microsoft auch nach seiner Verurteilung wegen wettbewerbswidrigen Verhaltens durch den Europäischen Gerichtshof bei der Vergabe von öffentlichen Aufträgen nicht grundsätzlich ausgeschlossen werden muss. Heide Rühle, binnenmarktpolitische Sprecherin der Grünen im Europäischen Parlament, hatte in ihrer Anfrage auf zwei Regelungen einer EU-Richtlinie abgehoben. Diese sehen den Ausschluss von Bewerbern an Ausschreibungen vor, deren berufliche Zuverlässigkeit aufgrund eines rechtskräftigen Urteils in Frage gestellt ist oder die im Rahmen ihrer beruflichen Tätigkeit eine schwere Verfehlung begangen haben.
Bei der Eröffnung der Vorjahresausgaben des LinuxTags und der IT-Profits hatte Berlins Wirtschaftssenator Harald Wolf angekündigt, seine eigene Verwaltung ab diesem Jahr auf Linux umzustellen. Das Abgeordnetenhaus verallgemeinerte diesen Beschluss Ende vergangenen Jahres in Richtung offene Standards. Nun lässt das IT-Dienstleistungszentrum Berlin (ITDZ) den Ankündigungen doch Taten folgen. In Zusammenarbeit mit Microsoft und der LIS AG (Linux Information Systems AG) entwickelte man den Prototyp eines Open-Source-Arbeitsplatzes, der vom Funktionsumfang einer Windows-Lösung entspricht und sich nahtlos in Active-Directory-Umgebungen integrieren kann.
Die Stadt München hat passend zum gegenwärtig in Berlin stattfindenden LinuxTag ihr im Rahmen des LiMux-Projekts entwickeltes Programm WollMux zur Verwaltung von Vorlagen und Textbausteinen als freie Software veröffentlicht. Bei dem Plug-in für OpenOffice handelt es sich um ein System etwa für Briefvorlagen, mit dem sich Dokumente komfortabel erstellen und Formulare einfach ausfüllen lassen. Münchens Bürgermeisterin und Auftraggeberin von LiMux, Christine Strobl (SPD), will mit der Freigabe vor allem anderen Gemeinden den Schritt zur Loslösung von Microsofts Windows und Office erleichtern: "Die Veröffentlichung bietet Interessierten die Möglichkeit, direkt von unserer Arbeit zu profitieren." Auch Weiterentwicklungen stünden gemäß dem Prinzip freier Software natürlich allen Nutzern zur Verfügung.
Zur Eröffnung des Behördenkongresses des BMI auf dem LinuxTag 2008 betonten IT-Verantwortliche von Bundesinnen- und -außenministerium die Bedeutung von Open Source in ihrer IT-Landschaft. Für Dr. Martin Schallbruch, IT-Direktor im BMI, liegen die Vorteile quelloffener Software in höherer und überprüfbarer Sicherheit, der Anpassung an die eigenen Bedürfnisse und der Unabhängigkeit von klassischen Produktzyklen. Offene Standards und Open-Source-Software sollen in der weiteren IT-Strategie des Bundes eine bedeutende Rolle spiele, sagte Schallbruch.

Auch für die IT-Leiterin des Auswärtigen Amtes, Anette Klein, sprechen die erhöhten Sicherheitsanforderungen ihrer Behörde für Open Source. Zudem erreiche man durch den verbreiteten Einsatz von Linux und Open Source im vergleich mit allen anderen Bundesministerien die geringsten Kosten pro IT-Arbeitsplatz. Bis Mitte 2009 sollen alle 11.000 Arbeitsplätze in den rund 230 Auslandsvertretungen sowie an den Ministeriumsstandorten Berlin und Bonn auf Linux migriert sein.
Das Bundesamt für Sicherheit in der Informationstechnik (BSI) steht mit der Migration seiner rund 500 PC-Arbeitsplätze auf eine Betriebssystem übergreifende Office-Suite kurz vor dem Abschluss. Rund 90 Prozent der Anwender arbeiten inzwischen mit StarOffice – etwa zu je gleichen Teilen unter Windows XP und Linux (Debian). Die Bonner Behörde hatte sich im Rahmen ihrer Open-Source-Strategie für einen Umstieg auf ODF als internes, Plattform übergreifendes Dokumentenformat entschieden. Die externe Kommunikation erfolgt über PDF-Dokumente. Daher standen nur OpenOffice sowie Suns kommerzielles Pendant StarOffice zur Wahl. Auf der Tagung Law Enforcement Technology (LE Tech) 2008 hat Microsoft Vertretern von Polizeibehörden aus über 35 Ländern Techniken zur Bekämpfung von Computer- und Internetkriminalität vorgestellt, darunter auch den Computer Online Forensic Evidence Extractor, kurz COFEE. Dabei handelt es sich um ein USB-Stick-Tool, das eine schnelle Abspeicherung von digitalen Daten für die forensische Beweissicherung gewährleisten soll. Das Tool hat Anthony Fung für Microsoft nach der ersten LE-Tech-Tagung im vergangenen Jahr entwickelt und bereits an einige Polizeibehörden, darunter auch in Deutschland, kostenlos verteilt. "In diese Dinge investieren wir beträchtliche Ressourcen", erklärte Microsofts Chefjurist Brad Smith. "Wir machen dies, um mitzuhelfen, dass das Internet sicher bleibt." Er räumte auch ein, dass Microsoft natürlich hier nicht ganz selbstlos handele, sondern vom Verkauf von Produkten an die Sicherheitsbehörden profitiere.
Zu den bizarrsten Themen, die auf der in der vergangenen Woche zu Ende gegangenen Virtual Law Conference in New York erörtert wurden, gehörte sicher die Frage, wie virtuelle Güter aus steuer- und bilanzrechtlicher Sicht zu behandeln sind: Wie und wann sind sie als Ausgaben absetzbar, über welchen Zeitraum können sie abgeschrieben werden? Die Diskussion steckt noch in den Kinderschuhen, doch Bryan Camp von der Texas Tech University School of Law wies darauf hin, dass es für die Abschreibung in den USA nicht darauf ankommt, ob der betroffene Gegenstand einer Wertminderung unterliegt. Rechtsanwalt Sean Kane machte darauf aufmerksam, dass virtuelle Welten bei Fahndungsbehörden unter Geldwäscheverdacht stünden und forderte deren Betreiber auf, sich rechtzeitig über Sicherungssysteme Gedanken zu machen. Auch sei es allenfalls eine Frage der Zeit, dass Umsätze mit virtuellen Gütern besteuert würden.
Das Bundesinnenministerium hat einen Leitfaden zum "Schutz kritischer Infrastrukturen" (PDF-Datei) für Unternehmen und Behörden veröffentlicht. Der 87-seitige Ratgeber soll helfen, möglichst alle Risikofaktoren im "Vorfeld von Ereignissen" zu erfassen, und so zum Schutz lebenswichtiger Einrichtungen und von Kommunikationsnetzen beitragen. Er ist als "Selbstanalysewerkzeug" zur Umsetzung in Einrichtungen der Bereiche Energie, Versorgung, Informations- und Kommunikationstechnologie, Transport und Verkehr, Gefahrenstoffe, Finanzwesen, Behörden, Verwaltung und Justiz sowie Medien, Großforschung und Kulturgüter angelegt. Dafür stellt das stark auf die Praxis bezogene Handbuch Methoden zur Umsetzung eines Krisenmanagements dar, die durch Checklisten etwa zum Risikomanagement abgerundet werden.
Indiens Premierminister Manmohan Singh hat zur Eröffnung der größten indischen Wissenschaftlerkonferenz am 3. Januar einen "Quantensprung" in der Bildungs- und Wissenschaftsförderung angekündigt. Man könne nicht mehr länger warten, es müsse dringend gehandelt werden. Bildung habe die oberste Priorität für die Regierung, wichtig sei die Entwicklung neuer Technologien vor allem auch für den Umwelt- und Klimaschutz, da man nicht die Fehler der alten Industrieländer wiederholen dürfe.
Um Wissenschaft und Technik zu fördern ist die "Gründung von 20 neuen Zentraluniversitäten, von fünf neuen Forschungsinstituten, acht neuen technischen Instituten und 20 neuen Instituten für Informationstechnologien" geplant. In den nächsten fünf Jahren sollen 1.600 polytechnische und 10.000 Berufsschulen sowie 50.000 Zentrum zur beruflichen Weiterbildung eröffnet werden. Eine Million Schüler sollen als Innovationsstipendien 5.000 Rupien erhalten, während 10.000 Studenten 100.000 Rupien pro Jahre bekommen sollen, die sich für ein wissenschaftliches Fach einschreiben. In wichtigen Bereichen wie der Atom- und Weltraumwissenschaft sind Bildungsprogramme geplant, um "Talente am Ende des Schulbesuchs zu erreichen". Überdies benötige man eine "Armee an Lehrern", besonders für die Lehre der Grundwissenschaften und der Mathematik.
Die Ausgaben für Bildung sollen, so der Premierminister verfünffacht werden. Bislang gibt Indien nur ein Prozent des BIP für die Bildung aus. Singh versprach, die Ausgaben schnell auf 2 Prozent erhöhen. (fr/Telepolis)
Eine klare Linie hin zu einer konsequenten Umstellung der IT-Landschaft innerhalb der Berliner Verwaltung auf freie Software wird es in der Hauptstadt weiterhin nicht geben. Die rot-rote Regierungskoalition im Berliner Abgeordnetenhaus hat am heutigen Donnerstag im federführenden Ausschuss für Kommunikations- und Informationstechnik einen Antrag (PDF-Datei) der Grünen zurückgewiesen, der eine genaue Kostenaufstellung für eine schrittweise Umrüstung auf Open Source forderte. "Es wird keinen Zeit- und Maßnahmenplan geben", hatte Berlins IT-Staatssekretär Ulrich Freise zuvor seine Ablehnung gegenüber dem Ansinnen auf handfeste Vorgaben zur Linux-Migration deutlich gemacht. Es bleibe dagegen beim Ansatz des Senats und der Regierungsfraktionen, "unter der Maßgabe der Machbarkeit und Wirtschaftlichkeit" sich auf "offene Standards" hin zu orientieren.
Der Bundesrechnungshof ist unzufrieden mit der Nutzung freier Software in den Behörden der Bundesverwaltung. In den vergangenen Jahren sei bei den dortigen über 300.000 PC-Arbeitsplätzen regelmäßig auf eine neuere Version der Betriebssystem- und Bürosoftware "des etablierten Herstellers" mit einem Marktanteil von 90 Prozent gewechselt worden, rügen die staatlichen Ausgabenprüfer die Microsoft-Vorliebe deutscher Amtsstuben. Alternativen anderer Hersteller oder anbieterunabhängige Open-Source-Software "wurden nur in Einzelfällen in Erwägung gezogen", heißt es in dem gerade veröffentlichten Jahresbericht (PDF-Datei) des Bundesrechnungshofes. Dabei dürfe freie Software "beliebig und ohne Zahlungsverpflichtungen gegenüber einem Lizenzgeber kopiert, verbreitet, verändert und genutzt werden". Trotz dieser Vorteile habe die Verwaltung bei der Umstellung auf neue Software hier aber "nur vereinzelt" Wirtschaftlichkeitsbetrachtungen unter diesen Gesichtspunkten angestellt.
