A recent report entitled “copyright policy and the right to science and culture,” presented at the 28th session of the Human Right Council in March 2015 by UN Special Rapporteur Farida Shaheed shed some light on this debate, however. Her report then attracted attention in the European arena in the context of the ongoing copyright reform. In this context, an international group of experts recently commented on it at the University of Strasbourg Centre for International Intellectual Property Studies (CEIPI).
In the report, the right to science and culture refers to Article 27 of the Universal Declaration of Human Rights (UDHR) and Article 15 of the International Covenant on Economic, Social and Cultural Rights (ICESCR).
In addition, “the human right to protection of authorship requires that copyright policy … ensure that authors benefit materially,” said the report. On this ground, the experts rejected the assumption that stronger copyright protection advances the authors’ material interests and drew an important distinction between human authors and corporate rights holders.

She stressed the fact that one of the key points of her report is that intellectual property rights are not human rights. “This equation is false and misleading,” she said.
The report also suggests that authors must be distinguished from copyright holders, she said, adding, “We should always keep in mind that copyright regimes may under-protect authors because producers/publishers/distributors and other ‘subsequent right-holders’ typically exercise more influence over law-making.”

Any change to the scope of copyright protection (including any new definition of protectable subject-matter or expansion of exclusive rights) needs to take into account. 3. When material is deemed to fall in the structural Public Domain in its country of origin, the material should be recognized as part of the structural Public Domain in all other countries of the world. 4. Any false or misleading attempt to misappropriate Public Domain material must be legally punished. 5. No other intellectual property right must be used to reconstitute exclusivity over Public Domain material. 6. There must be a practical and effective path to make available 'orphan works' and published works that are no longer commercially available (such as out-of-print works) for re-use by society. 7. Cultural heritage institutions should take upon themselves a special role in the effective labeling and preserving of Public Domain works. 8. There must be no legal obstacles that prevent the voluntary sharing of works or the dedication of works to the Public Domain. 9. Personal non-commercial uses of protected works must generally be made possible, for which alternative modes of remuneration for the author must be explored.
In sum the draft confirms the will to impose greater regulatory "convergence" and "harmonization" of future regulations between the EU and the US in the only interest of transnational corporations and the financial industry.
